GAR 86 (o): Mr. Lawrence Cunningham did instigate a physical altercation with Mr. Gavin Hall in the dining room of the Warragul Greyhound Racing Club on Tuesday, 10 June 2014.
The Stewards of Greyhound Racing Victoria conducted an investigation into a physical altercation that occurred between Mr. Lawrence Cunningham and Mr. Gavin Hall at the Warragul Greyhound Racing Club meeting held on Tuesday, 10 June 2014.
During the investigation, Stewards received evidence from registered trainer Mr. Lawrence Cunningham, Mr. Gavin Hall (Trainer), Mrs. Jackie Greenough, Mr. David Curtain and Mrs. Kay King.
After considering the evidence, Stewards charged Mr. Cunningham with a breach of Greyhounds Australasia Rules 86 (o) in that he did instigate a physical altercation with Mr. Gavin Hall in the dining room of the Warragul Greyhound Racing Club on Tuesday, 10 June 2014.
Under Rule 47.1 of the Greyhound Racing Victoria Local Rules a breach of GAR86 (o) constitutes a Serious Offence. As a result, on Tuesday, 7 October 2014 this matter was heard before the Racing Appeals and Disciplinary Board in the first instance under Greyhound Local Racing Rule 47.3 and Sections 83C(b) and 83M(1) of the Racing Act.
Mr. Lawrence Cunningham represented himself.
Mr. Ron Matthews (GRV Steward) represented the Stewards Panel. Mr. Lawrence Cunningham pleaded guilty to the charge.

After hearing all the evidence tendered, the RADB determined that Mr. Cunningham was guilty as charged and imposed a fine of $500 such fine to be wholly suspended for a period of 12 months subject to no further breaches of any rule relating to personal conduct during this 12 month period.
In assessing penalty, the Board took into account all the evidence and submissions, including the following matters:
(a) Mr. Cunningham’s guilty plea;
(b) Prior penalties for similar offences;
(c) Mr. Cunningham’s character and his clean history in the greyhound industry;
(d) Mr. Cunningham’s remorse for his actions.
