Barbara Buman Fined For Phenobarbitone Positive In NSW Greyhound
Greyhound Racing NSW Stewards concluded an inquiry into the analyst's reports that the urine sample taken from Isle Of Time after that greyhound had won race 9, the Betchoice.Com Stakes at The Gardens on 23 December 2011, had been analysed and found to contain the prohibited substance Phenobarbitone.
Evidence was taken from trainer Mrs Barbara Buman, and her husband Alan. Written evidence was entered from Dr C Suann the Australian Racing Forensic Laboratory Senior Veterinarian, Racing Science Centre Queensland, and Dr P Yore which was tendered by Mrs Buman.
Mrs Buman pleaded guilty to a charge under GAR 83(2)(a) in that she presented Isle Of Time for the race in question other than free of a prohibited substance in that the urine taken from the greyhound was found to contain Phenobarbitone.
It was established from the written evidence submitted by Dr Yore that the retired greyhound Rose ‘N Jane which resides at the Buman's suffers from epilepsy, and had been prescribed Phenomav tablets as a treatment for the condition since January 2009. Phenobarbitone is a constituent of Phenomav. Mrs Buman reasoned that the feed bowls for Rose ‘N Jane and Isle Of Time had been inadvertently switched, and that Isle Of Time had ingested a Phenomav tablet.
Mrs Buman was fined $700. In determining penalty, Stewards took into consideration Mrs Buman's guilty plea, her record of registration, the nature of the drug, and contrition for her actions. Penalties for breaches of this rule involving similar substances were also considered.
Under GAR 83(4) Isle Of Time was disqualified from the event, and the placings amended to read:
1st Sudden Splash
2nd Kelly's Hero
3rd Sins Sister
All other runners were elevated one finishing position.
Mrs Buman was notified of her right of appeal.
