Greyhound Racing NSW Stewards on Thursday 24th November 2011 conducted an inquiry into analysts’ reports that the urine sample taken from Miss Alsted after that bitch won Race 9 at the Nowra meeting on Sunday 21 August 2011, was found to contain the prohibited substance Caffeine and it’s metabolites, Theophylline, Paraxanthine and Theobromine.
Evidence was taken from trainer Mr Patrick Wood and from Australian Racing Forensic Laboratory Science Manager Dr Adam Cawley. Written evidence was entered from the Australian Racing Forensic Laboratory, Chem Centre (WA) and ARFL Senior Veterinarian Dr Craig Suann.
Mr Wood could offer no explanation for the presence of the substance in Miss Alsted on the day in question. Security at his kennels, which are located in a medium density residential area, is good, having consideration for the peculiarities presented in his circumstances.
Mr Wood was found guilty of a charge under GAR 83 (2) (a) in that he presented Miss Alsted for the race in question not free of a prohibited substance as the urine sample taken from the greyhound was found to contain Caffeine and it’s metabolites.
After considering submissions on penalty Mr Wood was disqualified for a period of seven months.
In determining the penalty Stewards took into consideration the not guilty plea entered by Mr Wood, his record in relation to this breach, which showed a previous suspension for the same substance in 2009, the nature of the substance involved, which is considered to be a stimulant in a greyhound, previous penalties in the relation to the Rule and this substance, and his personal circumstances, with Mr Wood divesting himself of any considerable investment in the industry. Stewards also applied a measure of both personal and general deterrence to the penalty having regard to the effects that such findings have on the image of greyhound racing.
Under Greyhound Racing Rule 83 (5) (a) Miss Alsted was disqualified from this race and the final of the race which was conducted on 28 August, with the placings amended accordingly.
