Barry Harper Found Guilty Of Slapping Greyhound

GAR 86(o): Mr. Barry Harper did slap a greyhound twice around the neck area, in the car park at the Sale Greyhound Racing Club on Sunday, 17 August 2014.

The Stewards of Greyhound Racing Victoria conducted an investigation into an incident in the car park at the Sale Greyhound Racing Club meeting held on Sunday, 17 August 2014.
During the investigation, Stewards received evidence from registered trainer Mr. Barry Harper and Mr. Michael Power (Trainer).
After considering the evidence, Stewards charged Mr. Harper with a breach of Greyhounds Australasia Rules 86 (o) in that he did slap a greyhound twice around the neck area, in the car park at the Sale Greyhound Racing Club on Sunday, 17 August 2014.
Under Rule 47.1 of the Greyhound Racing Victoria Local Rules a breach of GAR86 (o) constitutes a Serious Offence. As a result, on Tuesday, 7 October 2014 this matter was heard before the Racing Appeals and Disciplinary Board in the first instance under Greyhound Local Racing Rule 47.3 and Sections 83C(b) and 83M(1) of the Racing Act.
Mr. Barry Harper represented himself.
Mr. Ron Matthews (GRV Steward) represented the Stewards Panel.
Mr. Barry Harper pleaded guilty to the charge.
After hearing all the evidence tendered, the RADB determined that Mr. Harper was guilty as charged and imposed a disqualification period of 3 months (wholly suspended for 12 months pending no further breaches of GAR86 (o) and GAR106 (1) and (2) during this twelve month period) and a fine of $250.
In assessing penalty, the Board took into account all the evidence and submissions, including the following matters:
(a) Mr. Harper's guilty plea and remorse;
(b) The need to maintain the integrity of greyhound racing and particularly animal welfare matters;
(c) Prior penalties for similar offences;
(d) Mr. Harper's character and his clean history in the greyhound industry.
